A wide range of disputes can be referred to the OGA under the provisions of Part 2 Section 2 of the Energy Act 2016.
Upon the reference of a dispute, the OGA will first seek information from the relevant parties to decide whether to reject, adjourn or accept the reference.
If accepted, or if the OGA decides to consider a dispute on its own initiative, further information is likely to be sought in order to assist the OGA in its consideration. A non-binding recommendation will be presented to the parties that the OGA considers will best contribute to the fulfilment of the principal objective to maximise the economic recovery of UK petroleum whilst having regard to the need to achieve an economically viable position for the parties.
